ArtistDB Terms of Service

This terms of service will be subject to change at any time during the development of the project.

1. Introduction

ArtistDB is the open database of SFW/NSFW artists. It is an open-source platform enabling artists to showcase their work and connect with audiences created by NYT92org. By using our services, you agree to these terms and our commitment to creative rights protection.

2. Acceptable Use

All Users May:

  • Share properly licensed content or original creations
  • Utilize content for personal, educational, or developmental purposes
  • Engage in fair use practices with proper attribution

Businesses May:

  • Use API for commercial purposes under these conditions:
    • Obtain approval for usage exceeding standard thresholds
    • Maintain compliance with all license agreements
    • Implement reasonable rate limiting

3. Prohibited Activities

  • Unauthorized commercial redistribution of API access
  • Automated scraping
  • AI training/data mining without explicit consent
  • Harassment, impersonation, or illegal activities
  • High-volume requests exceeding the limit

4. Commercial Use

API Requirements:

  • Production use will not exceed the amont of requests per minutes
  • Testing/development exempt from these requirements

Revenue Sharing:

If the contribution is done via donation every month, the statement would not be applicable.

  • 1-5% revenue contribution applies when:
    • Annual earnings exceed between $50k+ per year
    • Using ArtistDB services (CDN, API, Resources, etc.) for commercial purposes
  • No revenue sharing for non-commercial, personal, or educational uses

5. Intellectual Property

Artists retain all rights to their work. By uploading content, you:

  • Confirm ownership or proper licensing
  • Grant ArtistDB non-exclusive display rights
  • Agree to resolve copyright disputes through DMCA process

6. Privacy

At ArtistDB, your privacy is our priority. We're committed to ensuring your personal information remains confidential and is never shared with third parties.

  • For Artists:
    • When you submit your work, rest assured that we will not share any of your personal information, including your email address, with third parties. We also fully respect your preferences if you wish to remain private or not be included in our public database. Your choices regarding your visibility are always honored.
  • For Users:
    • To enhance your experience and improve our services, we use analytics to collect data for internal analysis. To uphold our commitment to your privacy and avoid sharing information with external parties, we self-host our Posthog analytics. This means all analytics data remains within our secure environment. You do have right to opt-out of the analytics at anytimes.

7. Comments Guidelines

You can use the comment feature (Registered users only) to share your thoughts, opinions, or feedback with other users. However, please note the following guidelines to follow when using the comment feature:

  • Comments must be appropriate for all audiences.
  • Comments must not be offensive, hateful, or discriminatory.
  • Comments must not promote or encourage illegal activities.
  • Comments must not contain spam, malware, or viruses.
  • Comments must not contain any personal information.

By not following these guidelines, you may be subject to a permanent ban from using the comment feature or your whole account may be permanently banned and deleted.
